USTR Announces Extension of Some US Section 301 Tariff
Exclusions

The United
States Trade Representative (USTR), as part of its previously initiated 4-year review, has announced significant changes to
the current 429 China Section 301 tariff exclusions. Section 301 exclusions allow US importers to avoid paying additional 301
tariffs on some imports of Chinese origin products.
All
429 exclusions were set to expire on May 31st, 2024, but have been extended to June
14th, 2024, by the USTR. After that date, 265 of the 429
exclusions will expire as described below.
- Effective June
15th, 2024, 77 COVID-related Section 301 tariff exclusions will expire. Section
301 tariffs (duties) will be applicable on the related imports at that time and assessed in addition to other applicable
duties. Expiring exclusions may be reviewed in Annex D within the Federal Register Notice found at the end
of this section.
- Effective June
15th, 2024, 188 general Section 301 exclusions will also expire. Section 301
tariffs (duties) will also be applicable on the related imports at that time and be assessed in addition to other
applicable duties. Expiring exclusions may be reviewed in Annex D within the Federal Register Notice found
at the end this section.
- The 164 remaining
Section 301 exclusions have been further extended through May 31st, 2025.
Importers may continue to avoid Section 301 China tariffs if the product being imported meets the required exclusion
criteria. The extended exclusions may be reviewed in Annex C within the Federal Register Notice found at
the end of this section.
Section 301
tariffs are applied based on the date of the cargo entering the US for consumption or withdrawn from warehouse for
consumption.
US
importers should review this information and carefully consider the import of related products given these recent
changes.
